Order and Shipping
- Relationship and Applicability
Contract Composition:
This Order and Shipping Policy is an integral part of Carvemate Machines Inc ’s Terms and Conditions and is incorporated into that agreement by reference. Your acceptance of this Policy constitutes acceptance of all terms within the Terms and Conditions.
Governing Law and Limitation of Liability:
This Policy is governed by the Governing Law and Jurisdiction provisions set forth in the Terms and Conditions. Any limitation of liability (including the exclusion of consequential or indirect damages) related to this Policy is subject to the Limitation of Liability clause found within the Warranty Rules referenced in the Terms and Conditions.
- Ordering and Contract Formation
Contract Formation and Acceptance:
Products displayed on this Website constitute an invitation to treat. Your submission of an order constitutes an offer to purchase. An automated email confirming payment and order details (Status: Processing), which includes an invoice, is merely an acknowledgment of receipt of your offer and does not constitute acceptance. Payment confirmation or receipt of your order does not form a legally binding contract. A legally binding contract is formed only when we send you a Shipping Confirmation email, confirming that the product has been prepared and dispatched.
A copy of your agreement (order confirmation) will be sent to your registered email address immediately after checkout. This email constitutes valid documentation of your purchase and agreement.
Remote Area Ordering:
Due to logistical constraints, orders from remote regions (e.g., Northwest Territories, Nunavut) may not be processed directly through the Website. Please contact us via email to confirm order and shipping costs.
Orders to remote locations may incur additional shipping charges or restrictions, which will be communicated prior to dispatch.
- Notice and Contact Responsibility
The customer is responsible for ensuring that all contact information provided with the order (including email, billing address, shipping address, and phone number) is accurate and valid. All notices issued under this Policy (including those regarding contract formation, cancellation, or delivery changes) are deemed delivered upon the dispatch of the email. Carvemate is not liable for delayed or non-receipt of notices caused by the customer’s invalid or incorrect contact information.
- Pricing and Taxes
Your final payment will include the product price, shipping costs, applicable Canadian sales taxes (GST/HST/PST/QST) calculated based on your jurisdiction, and any government-levied environmental handling fees. You agree that you are solely responsible for paying all applicable Canadian sales taxes and domestic shipping-related charges, which will be itemized on the payment page.
- Payment and Authorization
Payment:
We accept most major credit cards and PayPal. All payments are subject to approval by the corresponding financial institution. You are responsible for confirming payment success; failed payment orders will not be processed, requiring reordering. We are not liable for payment authorization failures for any reason.
Billing Information:
Your purchase charges will appear on your credit card statement as “Carvemate CNC Machines” or another recognizable name registered in our payment processing system. All payment transactions are processed using encryption technology.
Fraud Review and Order Delay:
To ensure transaction security, all orders are subject to internal fraud and security review. We reserve the right to place any suspicious order “On Hold” and conduct a manual review. If an order is flagged as high-risk, we may, after notifying you, delay processing for up to three (3) business days. Should the fraud risk not be eliminated during the review period, we reserve the right to cancel the order at any time and will issue a full refund within ten (10) business days.
- Lead Time
Definition:
“Lead Time” refers to the period from our receipt of your confirmed order until the product is ready for shipment, excluding transit time. Transit time is determined by your selected carrier and shipping method.
Time to Delivery:
In-stock CNC machines are typically processed and shipped within five (5) to ten (10) business days, and other products within two (2) to five (5) business days.
Out-of-Stock and Delay Handling:
If a product is out of stock, we may offer a backorder option. The Lead Time for backordered items is an estimate only based on production completion and excludes transit time. We are not liable for delays beyond the estimated Lead Time.
If a product becomes unavailable or cannot be prepared within the estimated Lead Time, we will notify you by email with a revised delivery estimate. You will have five (5) days from receipt of the notice to accept the new date or cancel the order. If you choose to cancel, no charges will apply, and we will issue a full refund within ten (10) business days. Notwithstanding the five (5) day limit above, you always retain your statutory right to cancel under applicable law (for example, if the delay exceeds thirty (30) days from the original estimated delivery date).
We are not liable for delays or failures in delivery caused by events beyond our reasonable control, including but not limited to natural disasters, extreme weather, labor strikes, governmental actions, or carrier disruptions.
- Receipt, Acceptance, and Cancellation
Goods Acceptance and Damage Reporting:
-
-
- Immediate Inspection: The customer must immediately inspect the product packaging upon signing for the goods for completeness, visible shipping damage, or obvious missing accessories.
- Reporting Deadline: Any visible shipping damage or missing parts must be reported to us via email (with necessary evidence, such as photos) within ten (10) calendar days after receipt.
- Deemed Acceptance: Failure to report within ten (10) calendar days shall be deemed acceptance of the goods in good condition, which may affect subsequent claims for shipping damage or visible shortages.
- Hidden Defects: This acceptance deadline does not affect your statutory or warranty rights regarding hidden defects (non-visible flaws in material or workmanship).
-
Any damage incurred during transit is primarily the responsibility of the carrier. Carvemate will assist in filing claims, but is not liable for transit damages once the package has been handed over to the carrier.
Please note that your statutory or contractual rights to cancel or return products, including any cooling-off period, are governed by the separate Return and Refund Policy.
Order Cancellation Right (Pre-Shipment):
You have the right to cancel the order and receive a full refund via email at any time before your order has been shipped (i.e., before receiving the Shipping Confirmation email).
Post-Receipt Returns (Change of Mind):
If the customer wishes to return the full unit solely due to personal reasons (change of mind) within Ten (10) Calendar Days of receiving the product, an application may be submitted via email. The detailed policy and conditions are set forth in the separate Return and Refund Policy.
Merchant Right to Cancel:
We reserve the right to refuse or cancel any order for any reason, including suspected fraud, inability to fulfill, or obvious errors in pricing or description. If we cancel after receiving payment, we will issue a full refund within ten (10) business days, without interest or further liability.
All cancellations and returns are subject to the terms outlined in the Return and Refund Policy, and Carvemate reserves the right to refuse or adjust refunds where policy conditions are not met.
- Outbound Shipping
Shipping Methods and Costs:
We offer various shipping methods with different transit times and costs. Options and fees will be detailed on the checkout page.
Carrier Liability and Transit Time:
Transit time is an estimate, not a guarantee. We are not liable for any losses caused by carrier delays.
Shipping Address Accuracy:
While the Website offers an autofill function, the customer is responsible for ensuring the provided shipping address is complete and accurate. The customer is responsible for all costs (including re-shipping fees) resulting from the package being undeliverable or delayed due to an incorrect, incomplete, or unavailable address.
- Return and Repair Shipping and Packaging
All standards and requirements regarding packaging, carrier usage, liability for transit damage, and associated fees for return or repair shipments are governed by the specific terms set forth in the Return and Refund Policy.
